Open Letter from Afghan Human Rights Institutions
Subject: Request for Legal Accountability of Ms. Cheryl Benard for Complicity in Crimes Against Humanity and Whitewashing the Taliban Regime
To: Officials of the International Criminal Court (ICC), UN Human Rights Bodies, European Union, United States Government, Global Media, and the International Public
We, a collective of civil society organizations, legal institutions, and women’s rights movements, based on international legal principles, verified media reports, and official documentation, call for the legal accountability of Ms. Cheryl Benard for her role in assisting crimes against humanity through whitewashing the Taliban regime, denying structural violence against women, and misleading the global public.
Ms. Benard’s actions are not limited to her individual role as a researcher and political commentator. They must be viewed in the context of her close connection with her husband, Zalmay Khalilzad, a principal architect of the Doha Agreement with the Taliban, who has facilitated the group’s political inclusion internationally and promoted financial and diplomatic support for the Taliban in neighboring countries. Statements by Ms. Benard aimed at normalizing the Taliban must be understood as part of a coordinated and structured political collaboration.
Documented Statements and Evidence
In multiple articles and interviews, including an article in The National Interest (2024), Ms. Benard:
Denied the existence of gender apartheid in Afghanistan, claiming that women “move freely in the cities,” “work,” and “face no pressure from the Taliban.”
Described Afghanistan as “safe and desirable” for the return of Afghan migrants, stating:
“The Taliban may have their own ideology, but they have established order. The return of Afghan migrants is not only possible but desirable.”
Framed reports of women’s repression as “exaggeration,” effectively justifying the systematic exclusion of women from public life.
These statements directly contradict extensive evidence from international organizations and direct testimonies from Afghan women victims:
Richard Bennett, UN Special Rapporteur on the situation of human rights in Afghanistan, in reports to the UN Human Rights Council (June 2022, March 2023, March 2024), confirmed that the Taliban execute a systematic and coordinated pattern of gender apartheid, constituting a crime against humanity.
Official reports note:
“The Taliban’s treatment of women is targeted and systematic. Their exclusion from public spaces, prohibition from education, employment, travel, and extrajudicial punishments constitute the complete deprivation of women’s humanity.”
Dozens of Taliban decrees restricting women’s dress, work, education, mobility, health, and media reinforce a structural and legal framework of gender apartheid.
Reports from UNAMA, Human Rights Watch, and Amnesty International document hundreds of cases of detention, torture, enforced disappearance, and threats against protesting women, female employees, and civil society activists.
Direct testimonies from Afghan women, migrants, and activists, recorded in dozens of statements, petitions, and reports, corroborate these systemic violations.
These evidences are grounded not only in international reporting but also reflect the lived experiences of over 18 million Afghan women directly subjected to systematic gender apartheid and exclusion.
Legal Basis for the Accusation
Under Article 25(3)(c) of the Rome Statute, any individual who intentionally aids, abets, or facilitates the commission of a crime under the jurisdiction of the Court is considered a participant in the crime.
According to Article 7 of the Rome Statute, Taliban actions against women — including systematic exclusion from social, educational, and economic life, travel restrictions, and detention for “non-compliance with hijab” — constitute crimes against humanity and gender apartheid.
Ms. Benard, by denying these crimes, whitewashing the Taliban, misrepresenting international evidence and victims’ testimonies, and legitimizing return to a repressive regime, qualifies as an indirect accomplice under principles of complicity, enabling impunity, and collusion in whitewashing.
Specific Demands
Initiate a formal investigation by the ICC Prosecutor into Ms. Cheryl Benard’s role in facilitating the whitewashing of the Taliban regime and undermining women’s rights.
Suspend her professional positions in research and media institutions that enable such conduct.
Support legal complaints by Afghan women victims and migrants against individuals deliberately perpetuating systematic rights violations.
Convene an international or symbolic public tribunal focusing on the role of Western elites and media in legitimizing human rights-violating regimes, with a focus on Afghanistan and the experiences of Afghan women.
We declare: Distortion of truth is a subtle yet effective form of crime. Those who knowingly silence victims and whitewash perpetrators are complicit in oppression.

موضوع: درخواست پیگرد حقوقی خانم شرل بنارد به اتهام معاونت در جنایت علیه بشریت و سفیدنمایی رژیم طالبان
به: دادگاه کیفری بینالمللی، نهادهای حقوق بشری سازمان ملل، اتحادیه اروپا، ایالات متحده آمریکا، رسانههای جهانی و افکار عمومی جهان
ما، جمعی از نهادها و سازمانهای مدنی، حقوقی و جنبشهای زنان، با استناد به اصول حقوق بینالملل، مستندات رسانهای و گزارشهای رسمی، خواهان پیگرد قضایی خانم شرل بنارد هستیم؛ به اتهام معاونت در جنایت علیه بشریت از طریق سفیدنمایی رژیم طالبان، انکار خشونتهای ساختاری علیه زنان و گمراهسازی افکار عمومی جهانی.
نقش خانم بنارد تنها بهعنوان پژوهشگر یا مفسر سیاسی محدود نیست؛ بلکه باید در بستر ارتباط تنگاتنگ با همسرش، زلمی خلیلزاد، که یکی از طراحان اصلی توافق دوحه و تسهیلکننده حمایت مالی و دیپلماتیک از طالبان بوده، دیده شود. سخنان او در عادیسازی طالبان، بخشی از همکاری ساختاری و هدفمند سیاسی محسوب میشود.
مستندات و اظهارات قابل پیگرد
در مقالات و مصاحبهها، از جمله The National Interest (2024)، خانم بنارد:
وجود آپارتاید جنسیتی در افغانستان را انکار کرده و زنان را “آزادانه در شهر حرکت میکنند” و “کار میکنند” معرفی کرده است.
شرایط بازگشت مهاجران را “امن و مطلوب” توصیف کرده و طالبان را بهعنوان گروهی با “نظم ایجاد شده” توصیه کرده است.
گزارشهای رسانهای درباره سرکوب زنان را “بزرگنمایی” خوانده و بهگونهای سخن گفته که توجیهکننده حذف سیستماتیک زنان باشد.
این اظهارات در تضاد صریح با گزارشهای رسمی نهادهای بینالمللی و شهادت مستقیم قربانیان است. از جمله:
ریچارد بنت، گزارشگر ویژه سازمان ملل، در گزارشهایش به شورای حقوق بشر (ژوئن ۲۰۲۲، مارس ۲۰۲۳، مارس ۲۰۲۴) تأکید کرده که طالبان در حال اجرای الگوی هماهنگ آپارتاید جنسیتی است که مصداق جنایت علیه بشریت میباشد.
صد فرمان صادرشده علیه زنان شامل محدودیت در پوشش، اشتغال، تحصیل، تردد، سلامت و رسانه، ساختار آپارتاید جنسیتی را تقویت میکند.
گزارشها و شهادتهای مستقیم قربانیان از یوناما، دیدهبان حقوق بشر و عفو بینالملل صدها مورد شکنجه، بازداشت و تهدید علیه زنان را مستند کردهاند.
پایه حقوقی اتهام
ماده ۲۵(۳)(ج) اساسنامه رم: هر فردی که عامدانه در ارتکاب جنایت با کمک، تشویق یا تسهیل مشارکت کند، شریک جرم محسوب میشود.
ماده ۷ اساسنامه رم: اعمال طالبان علیه زنان، از جمله حذف سیستماتیک آنان از عرصه اجتماعی، آموزشی و اقتصادی، ممنوعیت رفتوآمد و بازداشت، مصداق جنایت علیه بشریت و آپارتاید جنسیتی است.
خانم بنارد با انکار و سفیدنمایی این جنایات، شریک غیرمستقیم در ارتکاب آنها محسوب میشود.
خواستههای مشخص ما
آغاز تحقیق رسمی توسط دادستان دیوان کیفری بینالمللی درباره نقش خانم بنارد در سفیدنمایی طالبان و تضعیف حقوق زنان؛
تعلیق جایگاه یا روابط حرفهای او در نهادهای پژوهشی و رسانهای غربی؛
حمایت از شکایتهای حقوقی زنان قربانی و مهاجران افغان علیه کسانی که به نقض سیستماتیک حقوق آنان دامن زدهاند؛
برگزاری جلسه بینالمللی یا دادگاه نمادین با تمرکز بر نقش نخبگان سیاسی و رسانهای غربی در مشروعیتبخشی به رژیمهای ناقض حقوق بشر، با تمرکز بر افغانستان و زنان آن.
تحریف حقیقت، شکل خفیف اما مؤثر جنایت است. کسانی که آگاهانه صدای قربانیان را خاموش و چهره جنایتکاران را سفیدنمایی میکنند، همدست ظلماند.
